Arkin Kaplan v. Jones

Litigator Stanley Arkin hired the firm to recover a substantial “success fee” from a former client, Tom Jones, one of Citigroup’s senior-most executives. Jones’s response was to counterclaim for alleged malpractice. The firm moved for summary judgment to dismiss the malpractive claims and to recover the success fee. In a decision which became the subject of a front-page article in the New York Law Journal, the trial court dismissed the malpractice claims but denied the fees claim, finding that a trial was necessary. Both sides appealed, and the Joe Matalon won both appeals. The Appellate Division, First Department, granted Arkin’s motion for summary judgment on the fees claim, and sustained dismissal of the malpractice claims. The New York Law Journal wrote a front-page article about the appeal.
