Yelena joined MSE in 2013, and was promoted to Counsel in January 2018.

At MSE, Yelena has represented clients in a wide variety of matters before state and federal courts and in ADR proceedings.  She has argued motions, drafted briefs and mediation statements, taken and defended depositions, interviewed witnesses, and worked closely with expert witnesses.  Yelena’s representations at MSE include:

  • Serving as lead counsel in a FINRA arbitration that resulted in a complete victory for MSE’s client.
  • Successfully representing a real estate broker in a lawsuit by a former employee to invalidate a noncompete agreement.
  • Representing a tech company in an adversary proceeding in the United States Bankruptcy Court for the Southern District of New York.
  • Second-chairing the defense of a large national law firm against a multi-million-dollar malpractice claim in the United States District Court for the Eastern District of New York and in a successful mediation.
  • Defending several AmLaw 100 law firms against malpractice claims in New York State courts.
  • In the United States District Court for the Southern District of New York, successfully representing a trademark licensee in obtaining a temporary restraining order and preliminary injunction against the trademark owner for breach of the licensee’s right of first refusal.
  • In New York state court, serving as lead counsel to an annuity beneficiary in a dispute with a prior beneficiary.

In addition to her work at MSE, Yelena volunteers as an arbitrator in the Kings County Small Claims Court.

Prior to joining MSE, Yelena litigated for five years at Ropes & Gray LLP.  There, she represented domestic and foreign clients in litigations, arbitrations, and mediations, including commercial, contractual, product liability, and bankruptcy matters.  Yelena also defended corporations and individuals in SEC, congressional, Justice Department, and state investigations arising under federal securities laws, the Foreign Corrupt Practices Act, the Anti-Kickback Statute, the Federal Food, Drug and Cosmetic Act, and consumer-protection laws.

In 2012, Yelena was specially selected by Ropes & Gray, through its Partners in Prosecution program, to serve in the Brooklyn District Attorney’s Office as an Assistant District Attorney.  In that role, she prosecuted felony and misdemeanor cases, drafted and argued motions, and negotiated plea agreements.

Yelena graduated with honors from Emory University School of Law in 2008, where she was a quarterfinalist in the securities-law moot-court competition.  Yelena earned her bachelor’s degree in economics in 2004 from Cornell University.
